Filing for Divorce in Tennessee

To file for divorce in Tennessee, you must first meet the residency requirement. In particular, according to Tenn. Code Ann. § 36-4-104 (a), either spouse must have resided in the state for at least 6 months before filing. Once you meet this requirement, you can commence the divorce process by filing a complaint and citing a ground for divorce – either on no-fault grounds or fault grounds (e.g., adultery, impotence, criminal conduct).

No-fault divorce (mutual-consent divorce generally takes 2-6 months to complete. Fault-based, or contested, divorce can take months to years, depending on how complex the disputes involved are.

Settling Your Divorce Disputes

Many divorces are complex and lengthy because of high-conflict disputes involving their marital matters. For instance, some common divorce disputes you and your spouse may need to negotiate are:

  • child custody and visitation;
  • child support;
  • property division;
  • spousal support.

If you and your spouse are on amicable terms, you may be able to settle the above disputes among yourselves without involvement from the court. You can also pursue mediation to negotiate a settlement, in which case a third-party mediator will professionally facilitate discussion between you and your spouse to find common ground on your post-divorce arrangement. If all else fails, though, you will need to proceed to litigation, where the judge will make the final settlement decision for your divorce disputes.
