What is Considered as “Domestic Assault?”

It is a common misconception that “domestic assault” only involves incidents in which violence occurs between romantic partners. While these types of cases are considered domestic assault and account for a large number of these crimes, spousal violence is not the only situation that can be classified as domestic assault. An act of violence can be labeled as domestic assault if the involved parties have any kind of close relationship; the relationship between the alleged perpetrator and the victim does not have to be romantic in order to qualify as domestic assault.

A case may be classified as domestic assault if an act of violence occurs between:

• Spouses, domestic partners, or even people who are casually dating
• People who have a romantic history but are not currently in a relationship with each other
• Roommates
• Parents and children, siblings, or any family members

Other Types of Violent Assault Crimes

When an alleged offender and victim in an assault case do not know each other or do not have a relationship that can qualify the crime as domestic violence, the incident may be labeled as assault, assault and battery, or aggravated assault.

Assault is the act of harming another person, although it can also be defined as threatening to harm someone. Assault and battery, therefore, is threatening to harm someone and carrying out the act.

Aggravated assault is assault that involves an aggravating factor, such as the use of a weapon. Aggravated assault may be considered as “intentional” if the assault was planned, or “reckless” if the assault involved negligence.
